This agreement made this day_______________________ between Akadamie Malinois LLC

Hereinafter referred to as "breeder" and________________________ hereinafter referred to as

"buyer".

Whereas breeder offers for sale, a Belgian Malinois, named______________________________

Sex _________ , AKC #___________________ , Microchip #___________________________

Whelped___________________ , Sire K9______________________________________ and

Dam

The buyer is purchasing the above described Belgian Malinois hereinafter referred to as "puppy", for the Sum of $2200.00, and it is further agreed by both the breeder and the buyer that the following conditions will be met and that no further warranties or conditions are expressed or implied. Breeder warrants that the above described puppy is a purebred dog, registered by the breeder with AKC. Buyer agrees that the purchase price of the puppy, less the deposit already made, is due upon taking possession of the puppy unless other arrangements are made in writing with breeder.

The buyer understands that the puppy is being sold on a limited registration status. Full registration will not be available along with breeding rights until the puppy is twenty four (24) months of age and has been OFA certified hips elbows and eyes. Certifications must be normal to excellent and there will be a fee of $500.00 paid to Akadamie Malinois LLC for purchase of said breeding rights. All expenses for this certification are to be paid by the buyer. The buyer agrees that, if an Akadamie Belgian Malinois is bred before these requirements have been met, the buyer will not have the ability to purchase breeding rights, or purchase further puppies from Akadamie Malinois LLC.

The buyer agrees that the puppy is being purchased as a personal dog and that the buyer is not acting as a broker, purchasing for a second party. Buyer agrees that the puppy shall not be sold, transferred or given to any individual or to any retail or wholesale establishment for the purpose of sale or resale to the public or to any research institution where medical experimentation or other practices take place. Breeder agrees that the buyer may for any reason surrender said puppy back to breeder at any time during its lifetime. Transportation expenses are the responsibility of the buyer. If for any reason the buyer decides that they want to sell ownership of the puppy, breeder will have the first right of refusal. In the event the puppy is returned, the buyer agrees to sign the necessary papers to the breeder as the sole owner of the puppy. No puppy can be returned without the AKC transfer paperwork. When surrendering a puppy, no monetary funds will be returned as it will be the responsibility of the breeder to care for, retrain, and find a suitable home for the puppy.

 

Breeder warrants the puppy has been properly cared for up to and including the date of this contract and will provide buyer with an individual health record for said puppy. Buyer agrees to have the puppy examined by a veterinarian within 72 hours of taking possession of the puppy and to send a copy of the medical record to the breeder. If for any reason the puppy does not pass the examination, the buyer may return the puppy, along with the registration papers and medical record, and a replacement or refund will be granted. Outside of this 72 hour period any health problems must be evaluated and proper diagnosis and treatment assessed. Any refund at this point will be at the breeders discretion as to how much will be refunded and when it will be refunded. Buyer agrees to properly care for the puppy by providing shelter and a secure environment, providing high quality food and maintain a vaccination and annual health exam up to and after one year of age. The buyer agrees to properly house the puppy allowing adequate exercise from being crated for excessive periods of time. No refunds will be considered in the event of abuse or neglect.

Buyer agrees that there is no guarantee for performance in any AKC or sport competitions.

Buyer agrees not to hold breeder responsible for any actions taken by the puppy off the premises of the breeding kennel. Breeder will not be responsible for any damage, acts of aggression or injury to another animal caused by the puppy. The buyer understands that upon taking possession of the puppy that the buyer assumes all responsibility and liability of the puppy.

This written agreement constitutes the entire agreement between breeder and buyer. Both parties agree that there are no other terms other than those set forth in this document and changes cannot and will not be made unless done in writing and executed by both parties.

Buyer and breeder agree to keep each other informed of their current addresses and phone numbers

Upon signing this contract, the buyer acknowledges that they have read and agree to the terms and conditions of this contract. It is understood that this contract has been entered into in the state of Oklahoma and is subject to the laws of that state. It is further agreed that if action is brought on this contract, it shall be brought in the state of Oklahoma, Oklahoma County.
